Village Snopes were right.  Plans were afoot to remove director K. McDaniel from the board, immediately following the bottle-throwing incident documented in the OC Sheriff’s report as Battery Report 09-038879.  While simple battery may include any form of non-consensual harmful or insulting contact, regardless of the injury caused. Criminal battery requires an intent to inflict an injury on another.  We have been unable to access photographs of the damage caused by the incident, so we are not able opine on the seriousness of the damage caused.

Snopes also assert that. Mr. John Paulus along with Ms. Freshley, were instrumental in the movement to oust director McDaniel from the board, while providing insufficient notice  for a meeting where removal was being entertained. No pun intended.  However, other snopes tell us that some residents were disappointed the removal meeting did not go forward, because  “… some members were gonna pitch up ripe tomatoes … while

batted them away with her water bottle and gave!”

Two reasons were presented to the Third board for not proceeding with the removal process: 1) Insufficiency of notice, calling the stated desire of two directors to go forward with the proceedings, not an emergency makes.  2)  Neither California law nor Third Bylaws provides for the removal absent specific reasons such as court order attesting to unsound mind, conviction of a felony, or court ordered breach under Article 3 of Chapter 2 of Nonprofit Mutual Benefit Law.

We sent emails to Third’s legal council to get reactions to the hurry up and wait removal action, given that directors opposed to the removal are generally credited with getting the new legal council in, in the first place.  We also contacted directors Paulus and Freshley.

As was the case with the first denied, then consummated political assassination of Stanley Felstein, we do not know if they will be back.  Perhaps it is all in the bottle water being used, but we do know that the Thrilla in the Village goes on!
