Question: Some homeowner associations in my neighborhood have written restrictions into their covenants, conditions and restrictions limiting the owners' ability to rent out their units, while others have no such restrictions. When I went to sell my unit, the real estate saleswoman told me she has a duty to warn all other salespeople and prospective buyers of the rental restriction. She said she needed my permission to include a warning in sales advertisements and with listing services that the buyer should plan to occupy the unit as this homeowner association's CC&Rs regulate and/or cap the number of rentals. To offset such restrictions and make it less difficult to sell, I was told that some owners offer to "carry back" financing. I can't afford to do this and have found that rental restrictions in my neighborhood are resulting in lowered sales and asking prices, with some units taking longer to sell. I don't want any interference or problems with my prospective sale. Can I opt out of the restrictions? Can I refuse to print that disclosure? Can I sue the board for lowering the value of my unit through those restrictions?

Ok, it does appear that Mr. Berding is quite perturbed about my statements and quotes from a D & O insurance article that uses the phrases “bad faith,” “criminal intent,” and “fraudulent acts.” He’s upset that I emphasized these words in my Commentary (WordPress Blog). ANSWER: There is no requirement in the Davis-Stirling Act (DSA) (Civil Code sections 1350 to 1378) that associations create or maintain reserve accounts in any amount. The DSA does require that associations with existing reserve accounts, regardless of the amount, provide titleholders with all of the information detailed in Civil Code section 1365. The DSA also does not require a professional reserve study. Many so-called reserve study businesses work to persuade associations that they must maintain a specified dollar amount in their existing reserve accounts, but unless an association has them or wants to create them, they are not required.

QUESTION: My small homeowner association is self-managed, and all board directors are homeowners and volunteers. There is no property management company. The board treasurer does all the association's bookkeeping and is audited by the other directors and a licensed certified public accountant yearly. As payment for the bookkeeping, the treasurer has been exempt from paying monthly association dues. These bookkeeping duties are not offered to any other homeowners. Is this legal and in compliance with the law? ANSWER: The Davis-Stirling Act does not provide exceptions or exemptions to the requirement of paying assessments for owners or board directors regardless of the work they do for the association. The board cannot barter association assessments for work performed or waive payment of assessments for any owner regardless of the reason or alleged justification. If it does, it is acting unlawfully.

An open letter to my friends and colleagues on the Rancho Santa Margarita City Council: Our wonderful city is facing the prospect of having to hold a special election to select a replacement for Council Member Thompson, who resigned last month, if an appointment is not made by the council before May 2nd. A special election would cost the city over $100,000 of taxpayers' dollars if a decision cannot be reached by the council to appoint a temporary replacement until the next regularly scheduled election. I believe this cost to the taxpayers is unnecessary.

The good folks on the neighborhood association board in Hub Hall Heights, with whom I have had a few encounters, sent her a cease and desist request against a Habitat home in the neighborhood. In the letter, they claim that as Habitat did not file plans and specifications for review by the association that they are in covenant violation. Coto de Caza, CA - The good news for Coto de Caza residents is that the quarter-to-quarter accident rate for the quarter ending March 31, 2011 is significantly down from the previous quarter. The bad news is that it is still at the same levels as when the community experienced its two traffic fatalities within a three month period between December 2005 and March 2006 Traditionally, the Coto de Caza governance (the CZ Master Association board of directors) has been more concerned with form, rather than substance. For example, while it pays a security company close to $2 million/year to act as a glorified courier service/meter maid, it spends just 5% of that on the California Highway Patrol (CHP), the only option in the community for real public safety. That is roughly $4.00/year per person. Big Daddy next door, the City of Rancho Santa Margarita, (RSM) pays the county some $8 million per year for Orange County Sheriff Department services, or some $160.00 per person. Any ideas as to what will happen when RSM annexes Coto de Caza.

In short, Chen believed his home had been wrongfully foreclosed upon by his two homeowners associations while he was out of the country. In 2003, he filed the instant lawsuit against the associations, the management company, and ALS, alleging wrongful foreclosure, rescission and restitution, breach of fiduciary duty, willful misconduct and accounting. A first amended complaint added claims against certain defendants for unfair business practices, violation of the Fair Debt Collection Practices Act, RICO, quiet title, and declaratory relief. Although not initially filed as a putative class action, Chen later sought to certify a class for three of his claims, for breach of fiduciary duty, unfair business practices, and for violation of the Fair Debt Collection Practices Act, the last against the ALS defendants only. The court denied the class certification motion, and in our prior opinion, we affirmed. (Chen I, supra, G035402.)

SANTA ANA, CA - Anthony Louis Fragoso, has been charged with killing two people by causing a head-on crash. According to the Orange County District Attorney’s (OCDA)office, Fragoso, 21, South Gate, is charged with two felony counts of vehicular manslaughter by unlawful manner of driving with gross negligence with sentencing enhancements for causing great bodily injury. If convicted, he faces a maximum sentence of nine years in state prison.

SANTA ANA - The Orange County District Attorney's (OCDA) Office is seeking the public's help in identifying potential additional victims of an attorney charged with having unlawful sex with two minors. Matthew Christopher Tye, 31, Irvine, is charged with eleven felony counts anent a minor under 16 for Jane Doe #1. For Jane Doe #2 he is charged with nine felony counts. He faces sentencing enhancement allegation for committing lewd acts on multiple children. If convicted, the defendant faces a maximum sentence of 24 years in state prison. Tye was arrested this morning by the Orange County Sheriff's Department (OCSD) and is being held on $500,000 bail.

Casa Grande AZ - A Casa Grande homeowners association was placed in receivership, following allegations that board members drained funds for their own benefit - including what was described as the “theft” of more than $600,000. Pinal County Superior Court Judge Robert Olson’s Sept. 30, 2009 order placed a receiver in charge of the Desert Carmel Lot Owners Association.
Last month, the Receiver filed charges of breach of fiduciary duty, breach of ethical duties, disgorgement, professional negligence, aiding and abetting, and breach of contract against the Maxwell & Morgan law firm as well as against Maxwell and his wife, personally. Except for the breach of contract, the above charges are torts — wrongful actions — permitting a claim for punitive damages, which the Receiver is seeking. Filing tort claims and seeking punitive damages against the HOA and the individual directors is the only effective means today that homeowners have against abusive boards. The law firm for the Receiver is Cheifetz, Iannitelli and Marcolini “The court finds that the parties controlling the DC Lot Owners Association were grossly negligent in failing to protect to, protect, preserve or detect these withdrawals, which constituted the bulk of the liquid assets of the association,” Olson said in his order. “This alone justifies the appointment of a receiver.”
