Cardinal Joseph Ratzinger, prefect of the Vatican Congregation for the Doctrine of Faith has a number of non-negotiable issues, including abortion, euthanasia, death penalty, cloning, stem celll research, homosexuality, education and family.  Others argue that in ethics, an important consideration is the application of the principle of proportionality to moral issues.  This principle is a safeguard against a distorting reductionism.  Applied to the upcoming presidential election, the principle asks us to look at the totality of the candidate’s policies and the nuances of their policies.

It is one thing for a person to vote for a candidate on the basis of their opposition to a moral stance, and another to vote for a candidate despite their opposition to a moral stance, when one has applied the principle of proportionality.

Consider the issue of abortion.  When the principle of proportionality is applied, the question may be “which candidate’s social and economic policies might possibly reduce the number of abortions and balance it with other issues such as the death penalty, stem cell research, health care, etc., and where each candidate stands on these life issues.

Please join us and vote for President George W. Bush and vote NO on all California propositions.

Vote wrongly if you please, but in all cases, vote.

 

CZ BOARD RECALL GAINS MOMENTUM!

In early September, 2004, a group of self described Concerned Coto Residents unhappy with the CZ board leadership compiled a letter with a number of issues dealing with lack of planning, Safety & privacy, Fiscal Responsibility & Transparency, and Abuse of Authority,  as listed below:

Safety, Privacy of resident information

  • Terminating the contract with the CHP, exposing our members to speeders on our streets, without putting in place any other pro-active traffic patrol

Providing an outside organization our names and addresses without the proper controls and without member permission violating our right to privacy.

Lack of Planning

  • Implementing a $100 Special Assessment to purchase the Welcome Home Center while at the same time providing revenues to outside organizations.
  • Failing to develop comprehensive goals and objectives to inform CZ members of the Board’s plans each year and to properly drive the budget process.

Fiscal responsibility & Transparency

  • Providing Association revenues to other organizations that have nothing to do with the CZ Master Association.
  • Subsidizing the other two Homeowner Associations in Coto and CotoCAN with CZ Revenues.
  • Ordering Keystone Pacific staff members, who should be totally focused on Association business, to support outside organization’s function.
  • Failing to properly fund our Reserves while at the same time giving CZ revenues away to outside organizations.

Abuse of Authority

  • Opening of the Oakview/Oakknoll gates, in complete disregard of the legal agreement put in place by former Board’s, to protect our members from unnecessary liability and security breach.
  • Discussing Open Session issues in Executive Session in violation of the law

The group then put the current CZ Board on notice and “… we are asking the Board to act in keeping with our governing documents and the law to remedy all of these issues as quickly as possible”.

Recall Movement Gains Momentum

Growing dissatisfaction with the current CZ Masters Board of Directors prompted a second meeting of Coto Concerned Residents, held Wednesday, September 29, 2004.  “Many in the community believe that Board Members have violated their fiduciary responsibility to protect the interest of  the 3,500 CZ members,” said Joe Morabito, a backer of the movement.

The purpose of the meeting was to discuss an appropriate course of action and was open to all residents.  So much so that the current CZ board president was one of the first to arrive at the meeting.    “He was crisp and very uninformed about everything”, said one of the participants.  When he didn't have an answer for Joe, he yelled next.  Very rude.  …participants really grilled him.  He had no answers and it was obvious he had done no research”, attendees concluded. “I did not attend that meeting at Joe's, but I have been in contact with him and support his efforts. In general I believe the Board is doing the best they are capable of doing. I happen to believe in a bit more conservative approach to spending other homeowner's money. The Board of Directors are entrusted with managing the property which is owned jointly by all CZ Master homeowners. Therefore, in my opinion, the board must always consider what is best for the HOA in its entirety and of course, how to best protect the CZ Master property.  Lennar chose to create and financially support Coto Can to provide for the social interaction of the community, a clear separation from the duties of the CZ Master Board of Directors. So if I were on the Board I would maintain a separation of those two groups. In addition I would do whatever is possible to ensure the safety of our streets, which has been undermined by the current Board. The final issue I will mention is the open gates at The Summit in south ranch. This is a flagrant violation of an agreement negotiated between CZ Master and Toll Brothers which the Board refuses to read or discuss with the land use attorney who represented CZ Master! I cannot comprehend their priorities, but they clearly are not mine” - Jan Glisson, former CZ board member.    We tried to reach various residents who openly support the current board for their perspective on the meeting and the movement in general.  All declined to comment.

This open approach differs significantly from how the current board was elected.  The Delegate and Others Group led by Paul Young emphasized, “keeping the strategy closed to outsiders”, until the candidates were revealed.  Interesting to see whether Coto has matured civically to handle open debates such as this one, which by the way is alive and active in the Coto Discussion Forum.

CotoBuzz has learned that at least three potential candidates have surfaced that would challenge the incumbents in either a recall effort or during new elections.  The Coto Concerned Residents leadership have assured Cotobuzz that there is critical mass and commitment to see changes are implemented with the CZ Board as soon as possible.  Finally there is movement to collect evidence that may eventually lead to a California Bar Complaint with regards to the performance of legal counsel in at least three areas:

·         Rule 1-120. Assisting, Soliciting, or Inducing Violations

·         Rule 3-110. Failing to Act Competently.

      Rule 3-100. Confidential Information of a Client

COTOCAN SELLS ITS SOUL

For the record, CotoBuzz has been a long time supporter and promoter of CotoCAN.

Recently, however CotoCAN violated a founding principle and has gotten too close to the current Board.  Consequently CotoCAN is rapidly becoming a lightning rod galvanizing the community.  

Community culture and identity grows out of grass roots effort, not mandated from the top down.  For a community to thrive, it must have shared goals and values.  That is, all members must carry their own load.  Current CZ board decisions, as well intended as they may be are misguided:

·         When CZ continues to subsidize the Coto Lifestyle for the Estates and the Villages converging in shared values is a monumental task.

·         When CZ board activity with regards to CotoCAN adds to the potential CZ member’s liability, achieving shared goals may be unattainable.

The CZ board president likes to say, “Perception over knowledge”.  In this case we believe that Perception is Reality.   What is your reality?

 

2004-2005 CZ Board Progress Report

Earlier in the year, during the CZ Board of Directors elections,  the incoming freshman director was quoted by the local mis-information media as saying “…I know this group and I can hit the ground running”!  Apparently he hit the ground so hard that he might have gotten a concussion and has been missing ever since.  Since he “took office”, the CZ board has been embroiled in the Welcome Home Debacle, where the board voted for a special assessment thinking the deal was done.   In this case, the freshman director admitted to having voted for the special assessment without having read all the related documentation, and only after he had numerous voice mail and email messages letting him know it was OK!  Keep in mind that by this time, the board has not offered the 2004-2005 Goals and Objectives and has not prepared a yearly budget.

Also, allegations that the board has compromised resident privacy  have surfaced.

It is now widely known that the board has consciously or unconsciously abdicated their responsibility to communicate promptly with Coto residents by outsourcing the monthly newsletter to CotoVoice, with proceeds going to CotoCAN.  The last explanation offered for this move was the newsletter was too expensive.  This is the same board that promoted a glossy monthly newsletter as a “great marketing strategy”, to discontinue its use a few months later.  A perfect example of a SAR strategy (Shoot, Aim, Ready!)

Six months later, the 2004-2005 Goals and Objectives have note been published, and the budget has not been finalized, but the board has authorized a monthly dues increase!

Other issues include the alleged  mis-management of the property management company, by using management employees to help out with CotoCAN events, while on CZ board money and not being available to handle resident issues.

QUESTION RE:  CANYONLIFE  USING WMD!

 

Dear CotoLady:

We read with interest the Behind the Gates column contained in the October 22, 2004 issue of CanyonLife.  We are confused.  I thought there was a concerted effort to recall the current CZ board.  The author makes a mockery out of the movement.  Is this true?

CotoLady:

We think that the concept of the Canyon having an "insider" write about what is going on behind gated communities is a great idea.  The problem is when the insider uses such column as a weapon of mass dis-information.  For example, in the Friday, October 22 issue, he writes " ...But our new farmer's market has raised the ire of a large number of vocal Coto de Caza residents.  Well, maybe two".  This could be humorous if it was true. 

He goes on to write about the large number of emails he had received from a Coto resident.  He describes how he even added up the word count!  Apparently the more verbose his writing are, the better they do at the Canyon!

And for his piece de résistance  he asks a rhetorical question:  "Maybe one of you can explain this exact e-mail I received from one of our concerned residents".  He proceeds to directly quote  a posting from the Coto Discussion Forum, without  context.  Apparently this author has no clue as to what a a virtual neighborhood is all about.  In all fairness, the Canyon's e-communities is so poorly attended that one can condone his lack of understanding.

Reminds me of the question posed to a money counterfeit expert:  “I suppose that for you to become an expert, you had to handle large sums of counterfeit money?” he was asked.   "No, quite the contrary, we only handle all types of real money.  The idea is that in the rare instance when we come upon fake money, we will be able to recognize it as an exception”, added the expert.  In the case of the  Gates author, since he is only exposed to high school essays he is not able to comprehend anything else.  Not having direct experience with virtual communities, he does not understand that a posting needs to be read in the context of the conversation at hand.

The author of the Gates, as a Coto de Caza resident, once he starts to use his position to mis-inform, he finds himself in a conflict of interest scenario at best and  in an ethical conundrum at best

Perhaps rather than taking the time to count the words of the email he receives, he should get a dictionary and try to comprehend what he reads?  He might also join The Coto de Caza Discussion forum so he gets direct experience with electronic neighborhoods.

I HAVE A PLAN

As  election  time  nears,  we  are  bombarded with political ads and speeches by candidates  telling us their great plans for running the country.

At  the  end  of  the recent presidential debate, for example, the Democratic nominee recited a litany of supposed cures for  nearly  everything  that ails

us,  beginning  each  sentence  with  the  phrase I have a plan.

The problem is  that  government  is  not  supposed  to plan our lives or run the country; we are supposed to be free.  That  our  public discourse  strays so far

from this principle is an unhappy sign  of  our times.

Those who believe in limited constitutional government  should worry every time a politician says,  I HAVE A PLAN

 How Taxes Work

This is a VERY simple way to understand the tax laws Lets put tax cuts in terms everyone can understand:

 Suppose that every day, ten men go out for dinner the bill for all ten comes to $100. If they paid their bill the way we pay our taxes, it would go something like this, the first four men -- the poorest -- would pay nothing; the fifth would pay $1, the sixth would pay $3, the seventh $7, the eighth $12, the ninth $18, and the tenth man -- the richest -- would pay $59. That is what they decided to do, the ten men ate dinner in the restaurant every day and seemed quite happy with the arrangement until one day, the owner threw them a curve, (in tax language a tax cut). "Since you are all such good customers," he said, "I'm going to reduce the cost of your daily meal by $20", so now dinner for the ten only cost $80.00. The group still wanted to pay their bill the way we pay our taxes, so the first four men were unaffected they would still eat for free but what about the other six -- the paying customers? How could they divvy up the $20 windfall so that everyone would get his "fair share?" The six men realized that $20 divided by six is $3.33 But if they subtracted that from everybody's share, Then the fifth man and The sixth man would end up being PAID to eat their meal So the restaurant owner suggested that it would be fair to reduce each man's bill by roughly the same amount, and he proceeded to work out the amounts each should pay And so the fifth man paid nothing, the sixth pitched in $2, the seventh paid $5, the eighth paid $9, the ninth paid $12, leaving the tenth man with a bill of $52 instead of his earlier $59. Each of the six was better off than before. And the first four continued to eat for free But once outside the restaurant, the men began to compare their savings "I only got a dollar out of the $20," declared the sixth man, pointing to the tenth "But he got $7!" "Yeah, that's right," exclaimed the fifth man, "I only saved a dollar, too, and it’s unfair that he got seven times more than me!" "That's true!" shouted the seventh man," why should he get $7 back when I got only $2? The wealthy get all the breaks!" Wait a minute," yelled the first four men in unison, "we didn't get anything at all, and the system exploits the poor!" The nine men surrounded the tenth and beat him up The next night he didn't show up for dinner, so the nine sat down and ate without him But when it came time to pay the bill, they discovered, a little late what was very important They were FIFTY-TWO DOLLARS short of paying the bill! Imagine that!

And that is how the tax system works. The people who pay the highest taxes get the most benefit from a tax reduction Tax them too much, attack them for being wealthy, and they just may not show up at the table anymore. Where would that leave the rest? Unfortunately, most taxing authorities    anywhere cannot seem to grasp this rather straightforward logic!

Senator Ducheny to  introduce a bill to protect residents from Incomptent HOA boards.

On Septmeber 30, 2004 Senator Denise Moreno Ducheny (D-San Diego) announced that AB 2598, her bill to protect homeowners in common interest developments from foreclosure for small amounts of delinquent assessments, was vetoed  by Governor Schwarzenegger. The Governor has agreed to work with Senator Ducheny next year to craft a bill that will receive a signature.

"I strongly believe that this bill was a reasonable compromise to preserve the ability of homeowner associations to collect legitimate debts while ensuring that homeowners do not lose a lifetime of savings in their home over a $120 debt," said Senator Ducheny. "However, I will take the Governor at his word that he is committed to working with me on a bill he can sign next year."
