However, it remains conspicuously silent on the most egregious firing of Juan Williams by NPR, including the most moronic description of the firing by NPR CEO Vivian Schiller – whom SHOULD BE fired immediately. A major reason for the warning is that the CZ Master Association board of directors' rhetoric and actions are diametrically opposed: On the one hand, CZ Master's Xochitl Yocham writes in the September 2010 Board Letter "Since I have been on the Board over the last 4 years, one intersection has repeatedly been brought to the board's attention as a less than safe for residents. For that reason, the board hired a traffic engineering firm to look at the intersection of Plano Trabuco and Coto de Caza Drive last year," and the board approved the construction of a refuge lane. With the right evidence, it is not too difficult to pursue a case to its logical conclusion - specifically naming the offending person, independent of the HOA board. Driver v. Hussein, No. A126534, Cal. App. Dist. 1, October 1, 2010. The breach of fiduciary duty claim relates to Hussein's conduct in his capacity as a member and director of the Homeowners' Association. It was specifically alleged Hussein failed "to conduct the affairs of the Association in good faith, in a manner believed to be in the best interests of the Association, and not in Hussein's personal interest." After detailing acts of purported self-interest, it was further alleged that Hussein "engaged in the above acts because of his dislike and ill-will toward Driver, and because he was intending to sell his unit and did not want to incur any expense even if such expense would benefit the Association and owners, and also had no interest in whether or not the Association was functioning properly or the property was in good repair."

The lawsuit also alleges that in addition to negligence and awarding themselves money that was not rightfully theirs, it violated the Elder Abuse Act. As a past board member of a homeowner association with over 140 members, I would like to ask why you have not addressed Donie Vanitzian’s concerns. For example, her statement “the proposed law does not impose penalties on errant board members, establish a victims’ restitution fund, or require statutory warnings to new purchasers.” Our membership called for a special election and subsequently voted out 3 board members who had not been representing the desired interests of members. Instead they implemented their own agenda without consent of the membership.

How to file a complaint against your homeowners association
If you have a complaint against your homeowners association, but government officials such as the Attorney General, the Sheriff’s Department, the Department of Real Estate or the District Attorney have told you to take a hike, the last resort is to file. This can be used as a template: See how careful the homeowner's attorney has supported his position with facts: documented events, the CC&Rs, bylaws, and state law. All of these documents must be provided to the court. Anything not submitted or said in court does not enter into the judge's decision.
