As a past board member of a homeowner association with over 140 members, I would like to ask why you have not addressed Donie Vanitzian’s concerns. For example, her statement “the proposed law does not impose penalties on errant board members, establish a victims’ restitution fund, or require statutory warnings to new purchasers.” Our membership called for a special election and subsequently voted out 3 board members who had not been representing the desired interests of members. Instead they implemented their own agenda without consent of the membership.

If you have a complaint against your homeowners association, but government officials such as the Attorney General, the Sheriff’s Department, the Department of Real Estate or the District Attorney have told you to take a hike, the last resort is to file. This can be used as a template: See how careful the homeowner's attorney has supported his position with facts: documented events, the CC&Rs, bylaws, and state law.
