The
Parasites (US Congress & FDA) in our Midst
For sometime now, we have been updating our list of Parasitic
Bureaucracies to support our argument that California and the country
are in dire need of a Bureaucracy Realignment and Closure Initiative-
We posist that such initiative, coupled with the Evil Twins - the US
Economic Triple Constraint: 1) Card Check 2) Health Care and 3) Cap
& Trade, and California’s Triple Threat: 1) Public sector
organized labor, 2) un-elected, un-checked parasitic bureaucracies and
3) lobbyists. is of national security importance.
The
California Law Revision Commission and the Evil Twins
For years, we have been warning against the Evil Twins: The US
Economic Triple Constraint and California’s Triple Threat - , with a
message mostly tailored to self-described fiscally conservative
legislators. We define the US Economic Triple Constraint as 1) Card
Check 2) Health Care and 3) Cap & Trade, whereas California’s
Triple Threat consists of : 1) Public sector organized labor, 2)
un-elected, un-checked parasitic bureaucracies and 3) lobbyists.
Interestingly enough, one of the them told us we were off base when we
argued against earmarks, because the “percentage was so small” he
said – that was some three years ago.

victims’ restitution fund, or require statutory warnings to new
purchasers.” Our membership called for a special election and
subsequently voted out 3 board members who had not been representing
the desired interests of members. Instead they implemented their own
agenda without consent of the membership.

piece published in the Red County last week, Assistant Director of the
Center for Constitutional Jurisprudence and adjunct professor at
Chapman Law School Karen Carpenter Lugo not only argues against the
building of a Mosque close to 9-11 Ground Zero, but argues for a
national mosque litmus test.Using what appears to be Islam-phobia, Ms.
Lugo quotes from Bernard Lewis’ Islam and the West: “There is only
a single law, the shari’a, accepted by Muslims as of divine origin
and regulating all aspects of human life: civil, commercial, criminal,
constitutional, as well as matters more specifically concerned with
religion in the limited, Christian sense of that word.”

The
Misguided DOE’s Gainful Employment Rule & Public Education
Reform
Rancho Santa Margarita, CA - Larry Sand, the president of the
non-profit California Teachers Empowerment Network – a
self-described non-partisan, non-political group dedicated to
providing teachers with reliable and balanced information about
professional affiliations and positions on educational
issues—information teachers will often not get from their school
districts or unions, recently made the argument that the Los Angeles
Times may have started a revolution in teacher accountability by
measuring teacher performance and posting it in its Los Angeles
Teacher Ratings web page using a technique called value add, where
value add is the difference between a student’s expected growth
and actual performance.
An
argument for a Paradigm Shift in Public Education – One in a series
Rancho Santa Margarita, CA - Arguably, there is a need for a paradigm
shift in public education. That is, a radical transformation, as
opposed to the continuous partisan bickering, such as the one going on
in CAPO.To be clear, “radical transformation” means different
things to different people - not in the words must mean something
demagoguery sense: visionary leaders see what others can’t see, for
example.

Teacher’s Union CAPORancho Santa Margarita, CA - It is an
understatement to say that the teachers’ union dislikes the
transformation going on in the Capistrano Unified School District (CUSD)
aka CAPO. – What with the last three elections placing Seven
Republican trustees, dubbed the Lucky Seven, on the board. On day
one of the Lucky Seven, union members threatened to recall the new
board members from office. Local union bosses called in
reinforcements from Then California Teachers Association (CTA).

A Capo teacher opines that CAPO teachers are nice - the problem is
with the fiscally responsible CUSD board members. We agree - CAPO

Third
Mutual Elections Void and Null – Necessary, but sufficient?
Laguna Wood Village, CA - Hillel Pitlik, Chairman for the
Third Board Inspectors of Election throws Martin and Chapman
under the bus, while failing to assume any culpability when he
announced yesterday that the Third Mutual elections are null
and void “ due to inadvertent deletions in the ballot
instructions/ candidate statements, prepared by Martin and
Chapman.” Pitlink adds that “The Board and Inspectors of
Election are in the process of establishing a new election and
that information will be posted as soon as available. Martin
and Chapman will reprint and mail the ballots at no additional
cost to the Third Laguna Hills Mutual,” and that the action
does not affect the United Mutual ballots or election. Or does
it? Should it?

In
Laguna Woods, Who sues First? Who sues Second? Who sues Third?
Laguna Woods, CA - In mid-June, the Third Mutual board of directors
filed a lawsuit against its property management company PCM with the
Orange County Superior Court, “asserting claims for breach of
contract, fraud by concealment, breach of fiduciary duty, violations
of the Unfair Practices Act (Business & Professions Code Section
17000, et seq.) and the Elder Abuse Act, and negligence,” according
to a Third Mutual press release.

to sue your homeowner association

boards for sabotaging owner requests for records and refusing to fix
maintenance problems in common areas that directly affect individual

and the boards. What are the steps I have to take?ANSWER: Suing to
obtain association records and suing to force an association to fix

typically be done in Small Claims Court. The latter must be brought in

Woods Third Mutual Budget Process: Now You See it, Now You Don't
Laguna Woods Village, CA: A savvy business person and a member of the
community has this to say about the Laguna Woods' Third Mutual Budget
Process:A number of things struck me upon watching the version 3
budget meeting for Third Board. According to John Paulus and Kathryn
Freshley, the board made a great effort to keep 2011 assessments at
the same level as 2010. And yet, their words are not completely
accurate. Yes, the total assessment we will pay next year remains
unchanged, that part is true. However, the Third Mutual part of our
assessment has increased substantially. The truth lies hiding
somewhere among these facts.

Hello All: How nice that we now have a “Canine Corral” in Coto so
that about 100 CZ Members have a place to run their dogs and crap on
common ground maintained by the other 3,450 CZ Members. I guess it is
a dog’s world, isn’t it. I still say that CZ should issue dog
licenses in Coto to cover the cost to maintain this big dog run.

Coto
De Caza Subsidies Qualify as Bellisimos
Coto de Caza, CA -The CZ Master Association's population stopped
growing some ten years ago and as the CZ population has aged, the
total number of residents has gone down. In fact, Joe Morabito, a
former member of the CZ Master Association board of directors,
continues to argue for a Senior Center - The CZ Master Association is
the largest homeowners associaiton in Coto de Caza.
Implications
of Arizona Courts and Gated Communities
The most expensive line item in most gated communities' budget is the
security budget, followed by a number of disclaimers stating something
to the effect that the community is not responsible for security - In
Coto de Caza the security budget for not security purposes, for
example, is now close to $2 million/year when you include the
ancillary items such s Keystone's involvement.
You
Cant' Fight Your Homeowners association
Here's an Alabama case where a homeowner encroaches on the common area
by building some steps to a lake. The HOA tells him to cease and
desist. He files suit against the HOA in which he argues that the HOA
was improperly formed since it never filed incorporation papers as
required by the CC&Rs, and a board was formed by a group without
the required quorum and with a board membership that violated the
CC&Rs. Based on this, the trial court agreed and decided in favor
of the homeowner. Victory? NOT!!!

Coto de Caza, CA - In the August 2010 Newsletter, Xochitl Yocham,

information anent CZ Master Association assessments: “There are two
other associations behind Coto gates, Los Ranchos Estates and the

do pay a separate monthly assessment to maintain their own association
property.” And consequently, apparently all is well – NOT

This is a solid First Amendment violation of the right to speak freely
on politcal matters. Supreme Court has upheld such rights. Any deed
restriction or covenant that is against public policy or is
unconstitutional is invalid and unenforceable. Long held law, thank
goodness! Now, you would think that the HOA attorney, Delgado. another
member of the CAI law firm of Carpenter Hazlewood, would know that.
Wouldn't you think so? It is interesting that the media always fails
to mention this affiliation with CAI, as many of these attorneys
lecture on how to live happily in an HOA. And they are supported by
your local town government through the HOA Academy and Leadership
Centre programs. Are the media and local supporting govenments part of
the unspoken alliance of No negatives about HOAs? Seek the truth!

As a past board member of a homeowner association with over 140
members, I would like to ask why you have not addressed Donie
Vanitzian’s concerns. For example, her statement “the proposed law
does not impose penalties on errant board members, establish a
victims’ restitution fund, or require statutory warnings to new
purchasers.” Our membership called for a special election and
subsequently voted out 3 board members who had not been representing
the desired interests of members. Instead they implemented their own
agenda without consent of the membership.

If you have a complaint against your homeowners association, but

court. Anything not submitted or said in court does not enter into the
