The CotoBuzz Journal, February 2010- The OC's New Dance Craze, The Nut Farm and a Leap to Irresponsibility in the CID

The Orange County's Newest Dance Craze:  The Mumbaugh!  02-08-2010 9:00 AM

Rancho Santa Margarita CA - A new dance craze is sweeping Orange County.  It is a fusion between Irish step dancing and California move.  It is not a re-incarnation of the Macarena, Salsa or Mambo.  It is more like Riverdance, the phenomenon from ten years ago; Riverdance is a theatrical show consisting of traditional Irish step dancing, and notable for its rapid leg movements while body and arms are kept stationary for the most part.  Dubbed the mumbaugh (rhymes with Mambo), like Riverdance it consists of rapid leg movement, but in this case,  in complete silence and in the dark, most popular with the politicians throughout Orange County, triggered by what we have called the Baugh Initiative.

Mission Viejo's New Dance: MumBaugh - Union Wins, Accountability Lost...Sort of

Thursday, February 04, 2010, 12:03:58 PM Go to full article

Mission Viejo, CA - If every politician in the nation was asked to pay the country, one devalued buck to pay off the national debt, every time he or she used the evil twins accountability & transparency or the name Scott Brown, you can be assured than China would not be the defacto economic superpower. Candidate Obama liked to said that “words must mean something”. There is a significant difference between the candidates promises and the president’s actions leading us to conclude that now the president things that “words don’’t mean jack.” Accountability is not simply saying “the buck stops here”, but being answerable and righting the wrong, as illustrated below.

Laguna Woods Directors Seeking Removal of Embattled PCM Executive

Laguna Woods Village, CA - In the on-going saga of the On-again, Off-again termination of embattled property management company, PCM's executive Milt Jones, seems like it is on again. In a letter from the United Mutual Board of directors being widely circulated through the community, the board is letting residents know that "Members of the Golden Rain Foundation (GRF) plan to seek the removal of Mr. Milt Johns, the current Manager of Professional Community Management, Inc. (PCM)." Because of the the tumultuous history of the community, we are unable to ascertain the underlying motive for the missive: Is it strictly informational? Is it trying to defend the embattled executive? Is it trying to promote the termination? After all, this is the same board that previously capitulated to Mr. Jones' ultimatum and took it like a baby.

Monarch Beach,  CA   A letter was sent to Antigua homeowners by Naomi Poulson, the Antigua Board of Directors, and the management company PCM, as an actual smear campaign to malign Doug Kirk, and others, who want to run for the board.  It is important to note that Poulson and the Board intentionally excluded several homeowners in the mailing of this letter, including Doug Kirk, Jorge and Carol Cordero, and myself. None of us received this letter.

Wielding a sharp racial sword, Democrats ruthlessly destroy the careers of Republicans on racial matters, accepting no apologies. Yet, using a glaring double standard, those same Democrats quickly give a pass to any Democrat, such as Senate Majority Leader Harry Reid who again displayed egregious racism.

Rancho Santa Margarita, CA - When looking at crime and vandalism in the Coto de Caza community, the only question seems to be the slope of curve but not the direction. There was a 20% increase in crime from the third quarter to the fourth quarter ending December 2009, for example, where burglary/theft increased from a total of 18 reported incidents to 31.

Editors Note: To add context to Mr. Loughrey's message, Milt Jones, the property management company issued an ultimatum to the Laguna Woods Village board of directors saying in essence: You will do as I say and you better sit down and shut up, or else - see below: The board took it without uttering a beep.

A plaintiff (GRF Shareholders) who brings a fiduciary duty claim is entitled to all tort damages. The most difficult part of a fiduciary duty claim is establishing the existence of the relationship (i.e., a traditional or a non-traditional fiduciary relationship) and the type of harm the client may have suffered. Once the existence of a fiduciary relationship is established (i.e., duty) and that duty is shown to have been breached, plaintiff is entitled to recover all those damages available in tort including punitive damages if the requisite oppression, malice and fraud are present. Thus, unlike a typical breach of contract claim, the damages which flow from a claim based on fiduciary duty can be much more far reaching.

Agoura Hills, CA - Is management of attorney-client privilege strictly a matter of ethics? Does it matter? Brian Martin SVP and general counsel of KLA Ten Corp. thinks there is a knowledge gap as evidenced by recent case law reminding attorneys that: Ø Conversations are not privileged simply because a lawyer is in a meeting Ø E-mails are not privileged because a lawyer is copied on it Ø Communication are not privileged when a lawyer serves as a conduit for the communication.

Coto de Caza's Leap to Commercialization of Information- No Bocce Ball Court of Morabito

Coto de Caza, CA - We previously wondered whether the actions taken by Coto de Caza's CZ Master association against its next door neighbor, the Village homeowners association for "call center abuse" was an indication that finally the CZ board of directors actually got it and were taking a small step toward fiscal responsibility, or simply a giant leap toward the commercialization of resident's private information. A plausible answer is contained in the latest association's newsletter.

15 Minutes Could Save You 15 Year in the Nut Farm

Agoura Hills,, CA - We love Geico’s (Government Employees Insurance Co.) accidental success with the green gecko character and subsequent advertising spots pitching the slogan, 15 minutes can save you 15% or more in car insurance. When not using the gecko, the company uses a series of rhetorical questions, such as Ø Is Too Tall Jones too tall? Ø Does Charlie Daniel's play a mean fiddle? Although lacking a gecko to pitch the theme, something similar can be said about life in a homeowners association – common interest development (HOA/CID) community: “15 minutes studying HOA/CID statue can save you 15 years or more in the nut house- not to mention your wallet, or your life in general”

What lurks beneath?...In Laguna Woods Village

Yesterday, February 07, 2010, 5:46:44 PM Go to full article

Laguna Woods Village, CA -Milt Johns was asked to resign as General Manager of Laguna Woods Village. Since he learned of the request coming he has made tracks to imitate Chicken Little in his most frantic attempts to scare the members into thinking the whole place will crumble without him. He had conducted a hyperactive PR campaign by attending numerous coffee klatches and propaganda meetings to get the word out about what a hale fellow he is. The question each and every resident here in Laguna Woods Village should ask on Tuesday at the United Board meeting is this: WHY? What Lurks Beneath?

Secession is not bad, according to CAI attorney: HB2153

HOA attorney Scott Carpenter, a long-time CAI member, lobbyist and Chair of its Legislative Action Committee, states on his new blog that these are his personal views, yet the blog contains his firm's imprimatur, "Carpenter, Hazlewood, Delgado & Wood blog", and Carpenter still remains the CAI LAC chair. Can a public figure make such a declaration and in all honesty expect the people to believe it? That would be like a member of a campaign staff claiming to make personal comments, so the candidate can disclaim any responsibility as to shared beliefs. Must we now ask CHDW and CAI whether or not they agree? "Could you clarify any differences of view?"
