On the one hand, CZ Master's Xochitl Yocham writes in the September 2010 Board Letter "Since I have been on the Board over the last 4 years, one intersection has repeatedly been brought to the board's attention as a less than safe for residents. For that reason, the board hired a traffic engineering firm to look at the intersection of Plano Trabuco and Coto de Caza Drive last year," and the board approved the construction of a refuge lane. And she continues "I would suspect that the residents of the community Grand Coto II ..are happy to see this project happening".
Since
our previous work on the most dangerous intersections in Coto de Caza do not
logically support the CZ Master Association's justification for acceding to Coto
II residents' request to build a refuge lane and is
more like another example of the association's expand, stimulate and subside approach to management, instead of the statue mandate repair, replace and
maintain, we asked Ms. Yocham and Bruce Banigan for a
persuasive argument supporting what we consider mis-use
of fund. We also suggested that if there was a
logical argument to built the refuge lane, was was the
association prepared to to with the rest of the the
most dangerous intersection in the community.
The question is more than academic: Since the
data shows that there are other more dangerous
intersection, and the board does not take action, then
the association's liability goes up. Worse,
while the association decides to build a refuge late,
it lets the California Highway Patrol's (CHP)
proactive traffic patrol
hours drop by almost 50%- this when data clearly
shows that the CHP has been the most cost-effective
tool to prevent traffic accidents.
Seems like the data supports our argument. Since we have not heard from the CZ board, we can reasonably conclude that the board continues to pursue its expand, stimulate and subside approach to management, instead of what by law, it is mandated to do: repair, replace and maintain.
Not convinced yet? Fair enough. In the same September 2010 Board Letter Xochitl Yocham warns pedestrians to follow the law: "All intersections are are a legal crosswalk area whether marked or not, per California Vehicle Code. The Code also states that a driver of a vehicle must yield the right-of-way to a pedestrian crossing a roadway within any marked or unmarked crosswalk at an intersection..," she writes.
Here again, the rhetoric does not match the action: The CZ Master association continuously subsidizes the Golf Club and other homeowners association.. In this case by encouraging club patrons to illegally cross the most dangerous Coto de Caza roads by posting "be careful with golfers" signs, such as the ones installed in San Miguel Road. All of this while denying residents' request to install "careful children at play signs".

and as a former Board Member of the CZ Master
Association, a 3,500 member homeowners association
located in Orange County, California. This
letter constitutes a formal complaint against the CZ
Master Board of Directors, and their agents CJ Klug at
Keystone Pacific Property Management, 29883 Santa
Margarita Parkway, Rancho Santa Margarita, California
92688 and James Harkin, representative attorney at
Caine, Walker and Harkins, 17821 East 17th Street,
Suite 140, Tustin, California 92780. The current
CZ Master Board of Directors and their agents have
consistently acted in violation of their fiduciary
responsibility, our governing documents and laws of
the state of California specific to homeowner and
corporate governance codes and statutes as follows The
Audacity of Coto de Caza Stupidity In
covering public safety in the community for the last
six years, I have learned that the GRUP Syndrome aka
Michael Jackson’s Syndrome – where adults refuse
to grow up, is not only alive and well in Coto de
Caza, but is also thriving REQUEST
TO RENEW CHP CONTRACTI understand that the CZ
Master Association board of directors is seriously
considering terminating the CHP contract for
pro-active traffic control by the end of the year.
As you may know, my father, Mr. Morteza Manian was
tragically killed in March 2006. I strongly urge
you to renew the CHP contract without hesitation

expected to report a 1.3 percent rise in violent crime
nationwide in 2006 — an increase for the second
straight year, Sheriff Michael Carona today
announced that criminal homicide, forcible rape,
