WWSKD - What Would Sheriff Keyes Do Re: CCW Issue?

You will not see his name in what I called OCSD Star Search - The Final Episode.  For that matter, Lt. Bill Hunt did not get any support from the Orange County Board of Supervisors either in that episode.

However, Kevin Keyes, a businessman who threw in his hat in the ring to fill Sheriff Carona's position, was kind enough to answer my questions with a focus on the ongoing CCW controversy.  With Mr. Keyes' response, I have only to hear from Ken Maddox and Commander Ralph Martin.

CBWhat are your thoughts on the current OC CCW controversy?

KEYES:  The Sheriff has Grand Jury reports from 2006 and 2007 outlining a laundry list of problems in the Sheriff's department and her first apparent action is the CCW issue.  OC has one of the smallest CCW per capita in the United States.  With some 3.3 million people, only 1,200 permits were issued.  Bill Hunt and I debated this issue at a public forum during the selection process and both agreed to a "shall issue" policy completely opposite to the appointed Sheriff - an issue, the OCBS did not even ask her a question on during the EEOC appointment process.

The taxpayer pay the bills and it seems her first act was to attack her employers.  Last week the Grand Jury noted it was her role to determine the policy on this and the OCBS should focus back on the more important and larger issues to the tax payers.  That said, I am hoping in the next election, since it is now the Sheriff's policy to determine the 2nd Amendment of the Constitution, our next Sheriff will agree with me and we won't need a 17 officer Sheriff escort in and out of public meetings for our Sheriff.

CB:  Why has the union not taken a position on this issue?

KEYES: They have by rigging the appointment process and getting us the Sheriff we have.

CB:  What would you do different in the jail management  issue?

KEYES: Actually many things.  I would like to privatize sections of it that are not cost effective. Rotate jail responsibilities throughout the department equally sharing the burden and it would put more senior offices rotating in with junior offices allowing more command and control and accountability.  During the selection process, I had several conference calls with one of the countries largest jail service providers on how to cost effectively implement this.  Not long ago, our state senator, Diane Fienstein was successful in setting aside 10 million acres of California for turtle refugee's, despite the fact California cannot build power plants, refineries or job creation cities.  To cure the overcrowding problem, I would set up tents out there and have the guests of the county take care of and manage these turtles so important to the federal government.  

CB: Are you planning to run in  2010 and if so, when will you announce?

KEYES:  The Sheriff's department has a budget of over 700 million per year making it almost more than a top Fortune company and there is not experience in a Sheriff's career that teaches them how to manage a business of this size. 

I am a businessman and believe the department should be run by a non union, public citizen that believes the tax-payers need to be protected.  I can see myself running if the people and support system can get in place.  The people of OC need one of their own that they can trust in the position, guard them against zealot unionized unaccountable bureaucracies and to Serve and Protect their interests.

Kevin you got my vote. Finally someone who is not afraid of big unions and is willing to make the necessary cuts to get the department in budget. 700 million dollars and there is a short fall? Are you kidding me? The OCSD is not a good steward with the money we give them now. They sure as hell don't deserve another dime until they can get OT under control. Kevin the first thing that you should be eye balling is to privatize some of those positions such as the BOS meetings. There is no reason why we are paying 40+ dollars an hour for deputies to stand around and text each other about how they want to "stick a pencil" in their eye. As for the CCW fix.................there is no fix. Leave it alone and make it shall issue like Kevin suggests. Your a shoe in Kevin. Let me know when you run. I'll be volunteering time to the campaign.

You may be surprised to know, but Mr. Keyes would have never made the BMA paper cut, as ordered by the BOS.

But then of course, neither would General Powell, or General David Howell Petraeus, much less a no nonesense business person. But then again, that is public service for you. Instead of Protect and Serve, will rather Disarm, Ridicule, Intimidate and Obfuscate.

I do agree that the OCSD could learn from the private sector. Most government agencies could use a good dose of the private sector. That said, law enforcement doesn't occur in a fiscal vacuum. Someone like Mr. Keyes could certainly play a role, I'm not so sure the title of Sheriff would suit him.

Okay, I admit I had to look up syllogism in my dictionary. You're definitely expanding my vocabulary Coto. As I recall, during the selection process Mr. Keyes stated that he would implement changes in the jail that made for good sound bites. Unfortunately the difficulty in classifying and housing inmates as well as the regulations of Title 15 would prevent him from making those changes. His ideas were fiscally prudent but not practical. If he had a law enforcement background he'd know that.

Again, I think he could play a role, but I'm not sure Sheriff is the right title.

Clearly I do not represent Mr. Keyes, just as much as I do not pretend to speak for Lt. Hunt, or any other candidate.

On the other hand, I do have extensive first-hand knowledge of the typical LE and or CJ candidate, and I can assert (a speech act) that law enforcement is not rocket science - if anything, intellectually, it is perhaps as challenging as any other management operation or less.

Your assessment (a second speech act) that because Mr. Keyes does not have law enforcement background and hence not qualified is extremely weak. Weaker than the assessment rendered against John Scully to take the helms of Apple (a computer company), when he was managing a marketing company (Pepsi).

A very strong argument can be made that in order to avoid tunnel vision and remove all the dead wood from the department once and for all, requires an outsider versed in strategy and fiscal restraint.

However, your relevance question is similar to the one I asked the BOS prior to the final paper cut, given that the BMA matrix would exclude a captain of industry, but would qualify a community college drop out with some LE experience, and given that we live in the world of bits as opposed to atoms: Does the BOS have any idea as to what the makeup of the department is, including the technological complexity, and what type of leader can be more effective? That is, will you try to force fit the department to the leader, or will you try to get a leader appropriate to the department? When I interviewed the Sheriff I asked if she was qualified to manage a technologically sophisticated environment - her response? "That question is irrelevant"

Seems like a pattern of hers, if the answer to the question is going to make her unpopular, or she just has no answer, the question is at fault.

With a budget as large as the OCSD's and the advancement of technology as applied to LE, your question is perhaps more relevant than many she should answer.

Do you know Mr. Keyes Dallas? How do you know any plans did not include Title 15 issues and some plans - he did note he had several conference calls with the largest private jail service company in the country so it would be better to assume they are also aware of the issues and this could have been discussed.

Mr. Keyes served in the military on nuclear submarines, his dad was career military. He has been in the private business sector for almost 30 years - he is active in the community at several levels, coaches his children in sports which provides conversations with other parents so he understands their concerns. He's busy in background politics and pays attention to the issues.

He is a nice guy, good father and a credit that someone in our county cares enough to put himself out there to make a difference. Maybe he would not win an election but he is one of the few that puts his voice up to be heard - and that is better then the 99% of the rest of us.

Interestingly Dallas' rhetorical question about whether Frank Mickadeit. was part of a left wing conspiracy has been gremlized....mmm. maybe I should dedicate a piece with my response. Suffice it to say that I made a compelling argument that Dallas may be partaking of some good stuff in the evidence room and is being very creative - hence, it may be interesting to dig deeper into that relationship.

Paraphrasing my response: Frank Mickadeit, like the Sheriff, seems to focus more on fluff than on substance - as in the his apparent infatuations with a certain trashy reality TV show.

While I was criticizing the BOS for the process used to select the sheriff, Frank Mickadeit was promoting Hutchens as the best candidate.

While I cried foul after the move from "to serve and protect" to Disarm, Intimidate, Ridicule and Obfuscate, Frank Mickadeit. seems to endorse Bates' the Sheriff and the GJ Shut Up Rule.

Okay, I've been beat up enough! Stop! If you don't treat me better I'm going away.

No, I don't know Mr. Keyes personally but I also found him to be a very nice guy and family man who truly wants to make a difference. Please don't take my comments as a personal assault on the man. His resume' and character are solid and I mean him no disrespect.

I'm sure Mr. Keyes made some contacts with Private Jail companies that helped to further his understanding of how jails work. He also made some Joe Arrapio type statements that I loved but realized wouldn't fly in California (probably to throw some red meat at his audience). I'm all for lock em up and throw away the keys but that's not the reality of the current situation.

For the record, when it became apparent that the BoS wanted to bring in a candidate from outside of the department my money was on Randy Adams from Glendale. I had Sheriff Hutchens ranked 3rd. I'd be curious to hear his take on this issue but he's probably moved on and won't involve himself in this issue.

You might be right - but his comments at the debate were him, he caters to no one. Never ask him a question you won't like the answer too because he is honest and open in his belief and will tell you.

He believes as he said that prison "should suck" you should be so afraid of it and don't want to commit a crime. Not be like a 16th century slave ship but there should be a penalty to crime. Criminals are coddled in our society and he believes that they should have it no better then our poorest - honest hardworking citizens that did not take away someone's rights.

Maybe do a "holes" approach but jails are now used to get college degrees when honest citizens cannot afford them - do you remember in LA County, even the vendors wrote a letter to complain how much money was spent on prisoners - food and coffee delivered daily of better quality then COSTCO.

Kevin was the President of my HOA for four years. Let me summarize him. He believes you never make the right decision - you make the decision right. He did more in four years then 20 years of Boards before him. He also says "A man can do the most amazing things, if he has the most amazing things to do.

He and his committee's organized:

1. Completely redesigned and had constructed entryway to HOA streets that were 30 years old.
2. Worked with the city and had them replace over 200 sections of broken sidewalks.
3. Replace over 400 trees
4. Negotiated and got over a million dollar loan for and HOA (almost impossible) and organized and managed committee's and vendors re-modeling 3 major pools and park areas.
5. Worked with the federal government and got our zip code changed to be the same as Shady Canyon - improving our home values and reducing the loss in the current market
6. Went to work every day and coached his kids sports.

Maybe not the Lone Ranger by racking up arrests but it does show someone that can understand a problem and create and implement the solutions - my 2 cents.

The way that you attempt to marginalize the Sheriff by linking her to these ultra left wing Hollywood types is what I find laughable. The story I read about the individual GJ members who supported the Sheriff's position indicates that they are NRA members and generally on the "right" side of the political spectrum. Your attempt to link Sheriff Hutchens and the GJ as part of the vast left wing conspiracy to silence opposition sounds utterly ridiculous.

I believe the GJ's message to the BoS basically said stay out of another elected's business. I believe the issue is more nuanced than that and therefore disagree with the GJ but the link to the Hollywood liberals is once again a stretch.

On the other hand and with Dallas' help, I now understand the Sheriff's reason for such a restrictive CCW policy.
As most of us suspected, the reason is not legal, and the reason is not philosophical. Rather, it is psychological - as in psychological castration.

Ever ask yourself with the millions of dollars spent and the centuries of "experienced" law enforcement officers people are killed in our jails -- maybe we need an experienced officer as sheriff - maybe we need to look at a new approach. Just be open to something new. Vote, it matters.

CHP DOES ITS JOB – CZ BOARD  PLEASE DO YOURS!  Despite the public abuse the CHP has received from the Coto de Caza board of directors ever since the board was coerced into bringing the CHP back for pro-active traffic patrol, figures indicate that the CHP is doing its job:  Trend for accident rate is down and close to pre-firing levels.   Just as important, the number of Coto residents arrested for DUI is down. See chart below for actual accident rate.
