Laguna’s Third Board to Answer for Ms. McDaniel’s Removal

As predicted, and according to court papers, a petition (30-2009-00120478-CU-PP-CJC) was filed Tuesday March 24, 2009 by the Nitschke Law Group, in Superior Court, on behalf of deposed Third director K. McDaniel.

Is it a coincidence that Peter Nitschke , a former assistant DA for 10 years and former member of the State Bar’s board of directors represents community activist and director Michael Curtis?
Even if this is not, the petition seems to directly contradict Third Board legal council’s assertion that removal of director Katie McDaniel from the Third board without cause, following an alleged bottle throwing incident, where Ms. McDaniel was reportedly physically hurt, was in fact a legal. Albeit not necessarily ethical.
Should Ms. McDaniel prevail, seems like she would be back on the board of directors, before Cynthia Conners officially attend the first Laguna city council meeting.
