Public Records Act Request work with OCSD!

Laguna Wood Village - We now have proof positive that although the OCSD is no-responsive in many cases, when people file a Public Records Act request, the department responds…kind of.

Example:   After months of trying to get information on FileGate, I tried reaching Lt. Griffin.  Since he would not return calls, I tried to talk to Sgt. Lisa Von Normheim and  Investigator Massey – they would not talk to me.

I then asked Mike Curtis to see if he had followed up – on February 1, 2009 Mike sent an email to the Sheriff’s department.

Since I now had evidence of inquiries, I filed a Public Records Request with the Sheriff on February 5, 2009, and although it took the department until February 17, 2009 to deny they had any records, Mike did get a response directly from the Lt. saying  “the incident was documented in an Information Report, not a Crime Report.  You were not listed as a suspect of a crime.” – which means that the FileGate was not robbery or burglary –  one of the FileGate outstanding questions.  Others are still open, such as if this was merely an Information Report, why was Investigator Massy working the the incident before the report was even filed, for instance.

The lessone learned is that for future reference, it is a good idea to send emails to the department first, – then call to follow up.   Although telephone records can be linked, it is too expensive and not worth the effort, should questions arise.  As in this case, the department denied ever receiving any inquiries, for example.
