Laguna Woods Village, CA - Katie McDaniel was removed March 13, 2009 from the Third Mutual Board for no cause, by board members who chose to side with the property management company. More than likely, part of “the cause” stems from an altercation during a closed door board meeting documented in OC Sheriff’s Battery Report 09-038879, alleging that board president Moore threw a bottle full of water hitting and bruising Ms. McDaniel.

Apparently the board also blames Ms McDaniel for the property management ultimatum to the community

Ms. McDaniel’s fellow directors Stanley Feldstein addressed the Third Mutual board to prevent the political assassination, complemented by a number of copies of his four-page memorandum Mr. Feldstein’s eloquent defense went unheeded, however, as the Third’s new legal counsel, Gary Kessler, insisted the removal was in fact legal. Mr. Paulus moved to remove Ms. McDaniel, seconded by Ms. Conner. Voting in favor of removal were 1) Moore, 2) Paulus, 3) Freshley, 4) Souza, 5) Meunnichow, 6) Conners, while voting against were 1) Stanley Feldstein, himself a victim of an earlier political assassination, 2) Don Lippert, 3) Dominic Burrasca, 4) Carol Skydell, while Ms. McDaniel was not allowed to vote.

Undaunted, Ms McDaniel applied for a temporary restraining order and on Friday, March 27, 2009, the Orange County Superior Court ordered the respondents (Third Laguna Hills Mutual) and all persons acting in concert or participating with them from, directly or indirectly are hereby restrained and enjoined from filling the vacancy on the Board of Directors created by the March 13, 2009 removal of Petitioner from the Board of Directors. And ordered respondents to appear before the court April 20, 2009, 2007, at 1:30 p.m., “..or as soon thereafter as the matter may be heard, to show cause, if any they have, why they and their agents, representatives and all persons acting in concert or participating with them should not be preliminarily enjoined from directly or in directly from filling the vacancy on the Board of Directors”

Shortly thereafter, on March 30, 2009, the Third Mutual board of directors held a special meeting to elect a director to replace the vacancy left by Cynthia Conners as she joins the City of Laguna’s city council. In a 5-4 vote, consistent with the named defendants in the temporary restraining order (TRO), Jim Bragg was elected over Dick Palmer, with Stanley Feldstein, Don Lippert, Dom Burrasca and Carol Skydell At the meeting, Ms. McDaniel made the following comment for the record: "Since I am being unlawfully denied my rightful seat on this board, and I am being denied a vote in this election to fill the seat of Cynthia Conners, I wish to state that I retain my right to take legal steps to redress this election and any other actions taken by the board in my absence."

In preparation for the April 20 court hearing, Ms McDaniel’s supporters have called residents to join in, in a public display of support. As of this writing, there are at least two vans caravanning to the courthouse on April 20th, in support of Katie McDaniel. Others had to be turned away because arrangements with the transportation company had already been made. These people have indicated they will drive themselves. At last count, there are several vehicles that will be driving with some four people in each vehicle.

Additionally, there have been phone calls from residents calling to express support for Ms, McDaniel and expressing regret because they will be out of town or unable to attend because of prior commitments - but they want to pass on their encouragement and support saying they are with Ms. McDaniel in spirit. There is even one resident who is having his daughter come and care for his wife, so that he can attend the court proceedings, and show support for Ms. McDaniel.

The article asserts that according to Third Mutual president Cynthia Conner, claims that the board is planning on removing director Stanley Feldstein are untrue.
