Coto de Caza Fires the CHP - Again!

Coto de Caza, CA - The CotoBuzz Journal has documented the one-sided hate-hate relationship between the CZ Master Association board of directors and law enforcement agencies in general, and the California Highway Patrol (CHP) specifically (CHP). In an open board meeting for example, a board member called the Orange County Sheriff's Department (OCSD) extortionists! Despite the public abuse the CHP has received from the Coto de Caza board of directors ever since the board was coerced into bringing the CHP back for pro-active traffic patrol, figures indicate that the CHP has been doing its job: - The Chart below was published Sept. 30, 2006.

Sadly, just one week prior to Rhianna Woolsey's tragic death (December 7, 2005) in what was the first traffic fatality in Coto de Caza in ten years, based on public safety figures, we implored the board and its legal counsel to re-hire the CHP. At the same time, Keystone Pacific, the property management company failed to renew road certification, rendering the rehiring of the CHP less then effective with fatal consequences. Three months later, septuagenarian Mr. Morteza Manian’s died as he was struck by a teen age female, while he was riding his bicycle. The teen was eventually arrested and charged with vehicular manslaughter, felony hit and run and resisting and delaying or obstructing an officer.
Selected activity leading up to fatal accidents, as published one year after Ms. Woolsey's death:

For
months leading up to the first tragedy, we
implored the Coto de Caza board of directors
to do something about the alarming increase in
traffic accidents as a result of their firing
of the CHP for pro-active traffic patrol
without a suitable replacement. No
action taken ·
We
submitted a number of comprehensive public
safety proposals for the Coto de Caza board of
directors’ consideration. No Action

Selected activity post first tragedy: ·
As
soon as we experienced the first tragedy, we
asked the Coto de Caza board of directors to
change their focus from pursuing personal
agendas over public safety: Instead of
convening a town hall meeting to discuss Coto
de Caza city hood, we requested that the
subject be changed to public safety. The
board decided to cancel the meeting, rather
than discuss public safety, ·
On
January 9, 2006, a group of concerned
residents known as the Coto de Caza Safety
Committee met with Jerry Mezger and Mitch Hill
discuss how the board and volunteers in the
Safety Committee could work together. Mezger
was emphatic that for volunteers to work on
the safety committee they had to renounce
their free speech rights, that their spouses
would not be welcome, and that if they did not
agree to these terms, they “should not
bother to come to the meeting”, scheduled
for later that day. Eventually the
chairperson refused to go along with the Coto
de Caza board of directors, so she was
terminated.

After
the president of the Coto de Caza board of
directors called CHP management
representatives extortionist during an open
board of directors meeting, and after uproar
resulting from the first tragedy, the board of
directors was coerced into bringing back the
CHP for pro-active traffic control.
·
The
second traffic tragedy is recorded, involving
an under-age teen driver. Members of the
board of directors are quick to blame the
deceased, who cannot defend himself, for
“vehicle code violations”, even though
official records of the case are sealed, since
it involves a minor.
·
Days
later it was learned that the property
management company had “forgotten” to
renew road-worthiness certification, thus
rendering any semblance of pro-active traffic
control useless. The board of directors
went on record to blame the lack of a
“tickler file”, alleging such tickler file
should have been prepared by the property
management company terminated over five years
earlier.

Numerous
allegations come to light concerning the
management of the private security service
provider. The board of directors say
there is no problem.
·
An
Attempted rape incident is reported in a
sub-association, inside the Coto de Caza
gates. The Coto de Caza board of
directors posts a note on the association’s
website to make it clear the incident happened
in a sub-association, thus implying that their
deeds and actions have no bearing on the case.
·
An
incident is reported in the Sheriff’s
blotter involving a female visitor and a Coto
de Caza private security guard. Members
of the current safety committee view the
Sheriff’s report as apocryphal and something
that can be discussed at a later time.
·
The
gardener knows he is getting a raise, and so
does the private security guard. CHP
management does not know if the contract with
Coto de Caza will be renewed.

No
public safety plans has been unveiled, one
year after Rhianna’s tragic death!

We now have unconfirmed reports that the CZ Master association has fired the CHP for traffic enforcement - Again!.
Officer Goodwin, a CHP
Spokesperson would not comment, and instead referred
us to the CZ Master association board of
directors. We have asked Vince Hylka,
president of the CZ Master Association board of
directors to let CotoBuzz readers if indeed the CHP
was fired again, and if so, for a compelling reason to
do so. As of this writing, we have not heard
from the local governance on the subject,
If it is true that the CHP has been fired again, then
we posit that this is a life or death decision.
The last time the association fired the CHP, two
traffic deaths were recorded in the community in a
three-month span. Data collected for the better
part of this decade, clearly shows a cause and effect:
When
the CHP is active, traffic incidents are
down.

and as a former Board Member of the CZ Master
Association, a 3,500 member homeowners association
located in Orange County, California. This
letter constitutes a formal complaint against the CZ
Master Board of Directors, and their agents CJ Klug at
Keystone Pacific Property Management, 29883 Santa
Margarita Parkway, Rancho Santa Margarita, California
92688 and James Harkin, representative attorney at
Caine, Walker and Harkins, 17821 East 17th
Street, Suite 140, Tustin, California 92780. The
current CZ Master Board of Directors and their agents
have consistently acted in violation of their
fiduciary responsibility, our governing documents and
laws of the state of California specific to homeowner
and corporate governance codes and statutes as follows

Jackson’s Syndrome – where adults refuse to grow
up, is not only alive and well in Coto de Caza, but is

understand that the CZ Master Association board of
directors is seriously considering terminating the CHP
contract for pro-active traffic control by the end of
the year. As you may know, my father, Mr.
Morteza Manian was tragically killed in March 2006.
I strongly urge you to renew the CHP contract without
hesitation

Coto de Caza Traffic Fatality In Three Months-
Coto de Caza recorded its first traffic accident
fatality in ten years in December of 2005. In
