Shhhhs! SECRET, SECRET, SECRET, SECRET, SECRET, SECRET Coto de Caza Elections February
3,
2008 In
case you did not notice, the CZ Masters Association
Notice on Proposed Amendments is SECRET!
- in fact, it is so secret, that the word
SECRET appears at
least 13 times, just in the first page of said Notice! What
does this mean? That
the method used to process these changes is so secret,
that non-one will know how people voted (or not) –
what we can already tell you are the
results: These
are not so secret and will guarantee that Coto de Caza
will continue to operate like a banana republic. What
this also means is that the average CZ resident may
elect a delegate, but cannot ask the delegate to vote
one way or the other, and the delegate
is not obligated to tell the resident how he or
she voted – why?
Because the process is Secret! Now, consider the actual ballot: Is it coincidental that the average self-absorbed CZ resident needs an attorney to decipher the voting instructions prepared by the CZ board of directors to let CZ residents choose between direct democracy, or the current most corrupt delegate systems, or is it by design? For references, before the topic of direct elections was in the radar screen of HOA/CID, we lobbied the Legislature n Sacramento to mandate direct elections, and have been fighting an uphill battle against what critics call the CZ the corrupt Delegate Systems in Coto de Caza Ever since Messrs Varo and Mezger took control of the CZ Master Association affairs, the largest homeowners association in Coto de Caza, they have consistently refused to consider reforming what is widely recognized as a “corrupt electoral system”, as a former member of the CZ board of directors often says. Even after California adopted direct election laws, the CZ Master Association board of directors arbitrarily decided to maintain the system. Such law took effect July 1, 2006, mandating associations to adopt election rules that apply to all elections requiring a vote by the membership, i.e., special assessments, CC&R and Bylaw changes, etc. We asked Cane, Walker & Harkins LLP, the law firm of representing the CZ Master Association the legal basis for the board's argument that the delegate system must remain in place. To date, we have not received a response. We also gave X. Yocham, president of the CZ Master Association board of directors the opportunity to comment on the legal basis for the CZ Master Association proposed changes to CC&Rs, as well as the process being used. To date, we have not heard anything from the board or legal counsel. But,
Shhhssss, everything contained here in is
Secret. After all, we already know the elections
results. Is Cuba with no democracy considered to be a Banana Republic? Since our current electoral process is the same as exists in Cuba , Vietnam and Communist China maybe the analogy is correct. Hopefully, through the amendment on the table, if we get direct popular election, that day will be equivalent to July 4 for CZ. I say we make it a Coto holiday. CotoCAN can plan a parade. I may even take off from work to celebrate. Joseph Morabito - former member CZ board of directors.
