Coto de Caza Standard of Service Performance – More
Liability

One
of the reasons often cited to mislead
residents…..…err attempt to justify the increase
in CZ monthly dues was the need to bring services up
to standard.
The
board has gone on record
and assert that since Keystone is unable to
hire competent people, the board now directly hires
their account executive assigned to Coto de Caza.
It is not rocket legal science to figure out
what happens to association liability as a result of
the board’s actions.
Since
the private security company is unable to provide even
bare-bones training required by law when securing
guard cards, the board has now decided to not only
develop a guard training program, but do the training.
Guess what happens to liability?
Since
the private security employees cannot spell post
orders, board members, with no prior experience have
issued new post orders……
this is an egg,
these are your brains…..any questions?
The
only question may be, is this an attempt to bring
services up to standard, or to lower the standard to
meet the services provided?
Oh
just great! Varo/Mezger, the most incompetent CZ
Board Members in the history of Coto are now training
our security guards? Surely, this must be
a joke; but should we laugh or cry? Joe Morabito
I am working on getting a list of the
Safety Committee members that are training the guards and also might get
my hands on something that if I do get it I will share with all of you.
Can't say what it is right now but its a very important document .-

By the way, the
training being provided to UPS employees by the board, formulated by the
safety committee, by any measure, is an “actionable item” –
therefore it should be documented in the safety committee meeting minutes
(by statue) – in fact, is a different story. CotoBuzz

All: Can we please talk employment reality specific to training UPS
guards. Once the CZ Board approves our Post Orders perhaps with
Safety Committee involvement if that is what the Board wants to do, it is
UPS’s complete responsibility to train their employees in accordance
with whatever laws may apply and our Post Orders. No CZ Member
should be involved in that training or anything else specific to
selecting, hiring, training or otherwise managing UPS or any other
supplier employees. Need I remind all of the guard that sued
Securitas and CZ concerning the beating/injuries he sustained from a wild
party in Coto. My understanding is that CZ was not found to have any
liability because past CZ Boards wisely never pieced the agency veil.
In other words, the guard was deemed not to work for CZ because we had
nothing to do with him personally. Any time, the dopes on the
current CZ Board pierce that agency veil; they expose our Members to
employment litigation. Please, CZ Board, maintain the arms distant
relationship with our supplier’s employees including Vinnie Davis.
CZ is facing a serious accident related lawsuit because of CZ Board
Member actions. We don’t need any more litigation naming CZ that
is the result of the current CZ Board’s dumb actions and decisions.

We are paying Universal about $1.6 million or more a year. I think
they should be able to train their employees for the money we are paying
them.
