Ethical Divide:  Liberal Coast Bar Vs. East Coast Bar

An  Legal Ethical Divide, a “domestic dispute”  or a Paradox?

August 8, 2007

The Miami Herald reports that an attorney who helped a buddy hide a stolen Florida State University national football title trophy as a prank, “has had his law license suspended for 60 days, starting this weekend, because he stashed the Waterford crystal trophy at his home in Tallahassee in 2004 and 2005, at a time when he was already a lawyer”

On the Liberal Coast, a typical response from the California Bar as a result of lawyer complaints, including allegations of Extortion, Forgery, Deliberate and reckless deception, Solicitation, Intimidation and  Embezzlement reads something like this:  The State Bar can discipline an attorney ore recommend discipline based on clear and convincing evidence of intentional or willful misconduct in violation of the State Bar Act of Rules of Professional Conduct…..the dispute against Joe Attorney should be resolved in court”.  Apparently a lawyer prank on the East Coast is a serious matter that gets an attorney disbarred, but you have to go to court on the Liberal Court for allegations of Extortion, Forgery, Deliberate and reckless deception, Solicitation, Intimidation and  Embezzlement!

In the prank case, the attorney in question was employed by state lawmakers.

Do we have a Legal Ethical Divide between the Liberal Coast and the West Coast, is it a “domestic dispute” in the prank case – that is, lawyer going after lawyer, or is term Legal Ethical a Paradox?
