COTO DE CAZA's CZ MASTER ASSOCIATION INTENT TO PETITION TO RECALL MITCH HILL

 

JUNE, 10 2006

 

 

Despite the many artificial road blocks created by the CZ Master Association Board of directors during the 2006 District Delegate Elections (including tampering with the election process, distributing wrong and misleading information, and using weapons of mass disinformation), and  the election of the 2006 Board of Directors, there was enough community discernment, that incumbent George Thagard was defeated, and two independently –minded directors were appointed to the 2006-2007 CZ Master Association Board of Directors.

 

If you attended the First 2006-2007 board of directors meeting, you realize that Public Safety is Coto de Caza’s Tar Baby.  For Coto de Caza residents and delegates who care about public safety, it is imperative that Yocham and Zipperman have the tools to do the job they were elected and promised to do:  Place public safety at the top of the list of the CZ Master Association Goals and Objectives for 2006-2007. 

 

By adding a minimum of a third independently minded director, you would have given Yocham and Zipperman such tools.

 

NOTE:  Contrary to the spirit of the recently enacted law, Varo/Mezger/Hill did not even wait to consult with the new board members and went on record (June 2006 CZ Master Newsletter) stating that the CZ Master Association will  have to deal with Delegates, Cumulative Voting, Quorums etc. - instead of simply direct elections!   Yocham, Zipperman, the message being sent is that your vote (and neither Coto residents’) count.  

Certain concerned Coto residents have gone on record (see comments below) to do  whatever it takes, including suing the associaiton, if the board proceeds with its reckless approach to electoral process.  We say, it is more cost efficient to change the board's composition now:

Therefore, we urge you to sign this petition and ask your district delegate to commit to vote for a recall of Mitch Hill (or VARO/MEZGER)

The law was the law and we had to conform. I would contend that direct popular elections for HOA's are now the law of the land in California effective July, 2006. The old Delegate, Quorum, Cumulative Voting corrupt system is dead and should be buried once and for all. Harkins should just go into our governing documents and remove any language that does not conform to the new law requiring direct popular elections effective July, 2006. It is just that simple.

I own three other properties involving HOA's and all have direct popular elections and it works just fine. If the current incompetent CZ Board and their suppliers play games on this issue and we don't have free and unfettered direct popular elections in 2007, I for one would donate monies to mount a court challenge of any election that is not held in accordance with the new law. So, Varo/Mezger/Hill/Thagard team either get with the new program or tell it to the judge. We are sick and tired of all the corruption and incompetence we have seen under your regime. Joe Morabito

While I am hesitant to remove board members from office, if any board member is not attending 25% of the meetings they are ineffective and merely taking up space. It does appear that Mr. Hill had one issue on his plate which was to convince the other board members to open the Oak View/Oak Knowl gates. I regret that the legal agreement with Toll Bros. and the Oak Summit sub association did not legally force future board members to do their duty and keep CZ Master a private community. Our attorney and Board never considered that any CZ Master board members would renege on their duty to protect CZ Master from public encroachment. Right now we have a board who has opened the gates in south ranch which allows anyone using the public trail access to CZ Master. Hopefully this will be stopped before a prescriptive easement is in place.

Happy to sign; but I think that Mitch Hill needs to do the honorable thing and just resign.  And, by the way, I believe that other Board Members should ask Mitch to resign because he has missed so many Board Meetings.  I would be saying the same thing about any Board Member who cannot fulfill the obligations of the job.  Missing 25% or more of Board Meetings as was the case with Mitch when last we counted, is actually cheating the community.  Mitch got the Oakknoll/Oakview gates opened, where he lives, in violation of a signed legal agreement exposing our Members to unnecesary liability.  Mitch has participated in all the fiascos along with the rest of the Varo team.  For these things and many others Mitch Hill along with Bob Varo and Jerry Metzer should be removed from office sooner than later. However, if nothing else, Mitch's Board attendance record requires that he step down.  It is just not fair to the community for us to have a part time Board Member who shows up to vote for fiascos; but is not really there to do the heavy lifting required to manage CZ.  Joe Morabito
 
P.S.  Varo & Company have hired numerous high priced Consultants because Board Members have not rolled up their sleaves and CJ Klug is just incapable of managing the day to day affairs of our Association.
