We don’t need no stinkin' law, WE are the law!

VARO/MEZGER/HILL:  Hell now, won’t go! – we will not leave the Coto de Caza board under any circumstances!

Besides public safety, what has sparked the interest of several Coto Discussion Forum participants and CotoBlogzz readers is the issue of direct democracy within Coto de Caza.  That is, given that recently the state legislature passed SB61 intending to obsolete a most corrupt district delegate and cumulative voting process, the question is, why did the Varo/Mezger/Hill board not adopt direct elections for the 2006-2007 board of directors elections?  The response from the board was that there was simply not enough time.

Then just before the 2006-2007 board of director elections results were announced, Varo/Mezger/Hill went on record stating that the Coto de Caza Board would still keep the district delegate system in place and cumulative voting – not even waiting to consults with the to be elected board members!

Although some community activists had hoped that SB61 would bring direct democracy to Coto de Caza, we predicted that as long as Varo/Hill/Mezger were on the board, this would not happen – and guess what?  CotoBuzz was right again!

Dear Buzz:

I am confused by the Election Rules included in the referenced send-out.  Why doesn’t it reflect the supposed newly approved State rules for voting of directors? 

The reason is simple:  Varo/Hill/Mezger want to continue to pursue their personal agendas.  They in fact announced that they would not abide by the spirit nor the law, PRIOR to the 2006-2007 Coto de Caza board of director's elections:  The message:  "We do not care what the people say or want.  In fact, we do not even care what the new board members think - we are going to do it our way"! Hello All:  There is additional legislation in the works to better clarify how SB 61, the new law governing elections is going to work.  Unfortunately, the new law does not automatically do away with our Delegate System.  It may take a vote of our Members to do that.  My guess is that incompetent CZ Board Members Varo, Missing Hill and Mezger will attempt to maintain the Delegate System as long as possible because it is easier to manipulate than would be the case with direct elections.  Remember, they were almost successful in controlling enough votes with each of them serving as Delegates to keep George Thagard in office.   And, our suppliers and others feeding at the trough have no incentive to change the system because it means that no-nonsense Board Members could be elected which will turn off all the subsidies and other monies going to suppliers.  Our Members must rise up to make direct elections the law of the land in Coto.  And, we absolutely need to hear from Zipperman and Xochitl on this issue sooner than later.  Power to the People.  We have to end the corruption that exists in CZ.  Joe Morabito 

Varo/Mezger/Hill could care less about the Law, regulations or ethical principles – their words and deeds make this absolutely clear:  Remember that we proposed to do away with the corrupt delegate system AND cumulative vote at least ONE year before SB 61 went into effect.  They would not even acknowledge these proposals.
 
Clearly the spirit of SB61 was to have a more direct democratic form of local government.  And clearly Varo/Mezger/Hill and advisors oppose it vehemently to the point of dictating the “new election rules”, BEFORE the election of the two new board members Yocham and Zipperman.  Is there any other plausible explanation? We have to get the law SB 61 changed.  I may fly up to Sacramento to lobby for a proper change since there is going to be additional legislation.  It really is that simple because unless we can force a vote by petition which may be possible, Varo, Mezger and Missing Hill will do anything and everything possible to maintain our corrupt Delegate Electoral System where they can cast cumulative votes as Delegates for themselves.  The system stinks from corruption.  The smell is disgusting.   Joe Morabito

Your efforts regarding SB61 are to be applauded and we are with you.  However, for Coto de Caza, and specifically for the Varo/Mezger/Hill regime, law and order does not apply – ANY law!

Remember that in the recent district delegate elections, Keystone sent incorrect and misleading information to residents, failed to properly inform residents about election process, then directly interfered with the elections, by having an association employee and Keystone employees call residents and potential district delegates that would support the Varo/Mezger/Hill agenda.  As if that was not enough, the board also allowed proxies and votes to come in after the established deadline, and on, and on, and on….

We have officially challenged the district delegate elections and the board elections, according to statue.  To date, there has not been a response to these challenges from Keystone, legal counsel nor the board.

What is really needed is a RICO ruling on the board, Keystone and legal counsel!- Buzz

 

Buzz:  This relates to the legal mess that could be coming if the CZ Board, who ever sits on it, does not follow very strictly the new law related to elections with or without Delegates.  If the rules are not followed exactly as written in accordance with the law, any Board Member elected with a violation of the rules is subject to challenge.  If the Board Member is subject to challenge, then it must follow that any vote and/or action taken by a Board Member deemed to be illegally elected, would also be subject to challenge.  The day will come when an enforcement action is taken by the Board and the Member will claim that the action is illegal because the Board Member was illegally elected and therefore not eligible to cast a vote in favor of enforcement.  I would bet the Pinnacles people, including none other than Jerry Mezger, who cost our Members a couple hundred thousand dollars with their silly fence issue, would have used any means possible including this electoral procedural issue if they thought they could get their way by getting a court to declare one or more of the Board members who voted for enforcement as illegally elected.  This is another reason to get rid of the Delegate System.  It is just one more overlay that could cause a legal mess if a challenge is feasible.  Just wait.  Much of what I have predicted in the past four years with all the fiascos has unfortunately become reality under the Varo Regime.  This one is another accident waiting to happen much like the tragedies we have had on our streets in the past few years.  I can see the train coming.  Joe Morabito
